20 December 2020 last day to request renewal of residence permits extended due to COVID-19 in Spain, subject to 90 days “grace period”
If you have a residence or student permit in Spain that expired between 00:00 on 15/12/2019 and 00:00 on 21/06/2020, it was automatically extended during the National Emergency State in Spain based on Article 1 of Order SND/421/2020, of 18 May (BOE num. 142, of 20/05/2020).
Spain declared this measure to ease the situation of many thousands of foreigners affected by the health crisis caused by the COVID-19.
This automatic extension was valid for 6 months after the end of the National Emergency State, and this term is about to finalize.
The last day to apply for a renewal of your automatically extended residence or student permit is 20 December 2020.
However, the Spanish authorities allowed an exception: it is also possible to submit your renewal, extension, or modification application within 90 days after this extended period (that is to say, until 19 of March 2021), only in cases of:
- Temporary residence and/or work permits,
- Temporary stay permits for study, student mobility, non-working practice or voluntary services.
When you apply for a renewal after 20 December 2020 the Immigration Authorities reserve the right to impose sanctions for delayed application.
Full text of Article 1.6 of Order SND/421/2020
“1.6. The renewal, extension or modification of the authorisation which has been extended in accordance with the provisions of this Article shall be governed, as regards procedure, requirements, effects and duration, by the provisions of the implementing regulations according to the type of authorisation which has been extended. The corresponding applications may be presented at any time during the validity of the extension or up to ninety calendar days after the end of its validity, without prejudice to the sanction corresponding to the delay. In any case, if the latter request is favourable, the start of the validity corresponding to the new authorisation shall be retroactive to the day following the expiry of the extended authorisation.”
